TERMS AND CONDITIONS

These Hamptons Streamliner Terms and Conditions (the “Terms and Conditions”) are agreed to by any purchasers of a seat and passengers (collectively, “Client”) on the Hamptons Streamliner motor coach service (the “Streamliner”) sold by Blade Urban Air Mobility, Inc. (“Blade”).

  1. General. Blade desires to act as an agent for Client and arrange motor coach transportation services between Client and The Jet Inc. and/or any other third party operating partner (hereinafter referred to as "Operator"). CLIENT ACKNOWLEDGES AND AGREES THAT BLADE IS ONLY ACTING AS AN AGENT OF CLIENT FOR THE ARRANGEMENT OF THE TRANSPORTATION SERVICES DESCRIBED HEREIN.
  2. Payment. Full payment must be received in order to secure the Seat(s). Blade cannot guarantee the availability of a Seat until payment has been received.
  3. Tickets. Tickets are limited as endorsed and are non-transferable. The unauthorized resale of tickets is strictly prohibited and will be prosecuted. Tickets are valid ONLY for the schedule, date and time for which purchased. All passengers must be checked in with an attendant ten minutes prior to departure. Clients who fail to modify a trip at least 2 hours prior to departure or who do not board the Streamliner at least 10 minutes prior to departure will be considered a no show and all fare will be forfeited.
  4. Cancellations and Modifications. The cancellation and change policies applicable to the Streamliner can be found at https://www.blade.com/p/cancellations under the “Hamptons Streamliner” section, and are expressly incorporated by reference as if full set forth in this Terms and Conditions.
  5. Travel. Every passenger must present a government issued photo identification that matches his or her name on the trip manifest to participate in the services, and every passenger is responsible for his or her own baggage and personal effects at all times during the services. Blade reserves the right to make changes in the published itinerary or route whenever, in its sole judgment, conditions warrant or if changes are deemed appropriate for the comfort, convenience or safety of the passengers. Blade and Operator are not responsible for delays caused by breakdowns, road conditions, weather or conditions beyond Blade’s or Operator’s reasonable control. In the event of a force majeure event, Blade reserves the right to cancel, terminate, divert, postpone or delay any scheduled trip without notice with no liability except the issuance of a refund made to the original form of payment. A force majeure event means: (1) any condition beyond Blade’s or Operator’s control including, but without limitation, meteorological conditions, acts of nature, riots, civil commotion, embargoes, wars, hostilities, or disturbances (actual, threatened or reported); (2) any strike, work stoppage, slowdown, lockout or any other labor related dispute involving or affecting The Jet’s services; (3) any government regulation, demand or requirement; (4) any shortage of labor, fuel or facilities of Blade, Operator or others; (5) any pandemic, similar instance or resulting “shelter in place” orders; or (6) any circumstances not reasonably foreseen, anticipated or predicated by Blade.
  6. Seating. For your comfort during the trip, seats and footrests have been intentionally designed to operate pneumatically with compressed air, which allows all passenger seats and footrests to move during the ride. While the seats and footrests do have certain safety features, by utilizing the services and riding on the Streamliner, you are acknowledging the motion of the seats and footrests and the potential risk to yourself, any animals (in accordance with applicable animal and pet policies) or children and agreeing to use caution in regard to the same. Seating is not based on race, color, creed, national origin or any other protected characteristic. All travelers are required to check-in with a representative of Blade a minimum of ten (10) minutes prior to their scheduled departure.
  7. Fares & Fees. Fares are valid ONLY for the schedule, date and time for which quoted. Discount fares are subject to date, time and schedule restrictions. Fares may be subject to additional charges including taxes and fees (such as credit card processing fees and upgrade/add-on fees). Fares are payable in US dollars only unless stated otherwise. Fares are subject to change and may be higher during holiday and peak periods. More information on specific fare classes and restrictions can be found on Blade’s website.
  8. Luggage. Each passenger is allowed two large suitcases or carry-ons. Large bags will be stowed in a compartment beneath the Streamliner, and carry-ons can be stored in the overhead bins onboard. Purse hooks are available at all window seats onboard the Streamliner. For any luggage exceeding these requirements, purchasing the Excess Luggage upgrade allows for one additional bag (a maximum of three per passenger) and/or oversized items such as golf clubs or surfboards. Furthermore, Blade and Operator and their employees and representatives may reposition or remove from the Streamliner entirely any piece of luggage or personal item that they deem to be a potential safety or security risk in their sole discretion. You hereby authorize Blade, Operator and their employees and representatives full rights to reposition or remove from the Streamliner entirely a piece of luggage or personal item that we view to be a potential safety or luggage risk. Oversized luggage, including bikes, must be booked in advance via our Flier Relations team, who can be reached at info@blade.com or (844-359-2523). Blade does not guarantee the accommodation of such items if they are not booked and confirmed in advance.
  9. Pets. Pets are allowed to accompany passengers on the Streamliner for an applicable fee. Any pets under 25 pounds must remain inside their case, carrier, or kennel, with the door securely closed. Any pets over 25 pounds must remain in front of the passenger seat at all times. Blade and Operator reserve the right to refuse any pets that they or their employees deem disruptive, unruly or unsafe in their sole discretion. By using the services, you acknowledge and agree that a pet’s presence on the Streamliner involves certain known and unknown risks, including but not limited to, accidents or injuries arising from or related to the services (including, but not limited to, injuries related to the seats and footrests) and you assume all risk of injury (including death) that your pet may suffer while participating in the services. You further acknowledge that the provisions set forth in the “Limitation of Liability” section below expressly apply to any pets traveling on the Streamliner.
  10. Services Animals. Service animals that are “trained to take a specific action when needed to assist the person with a disability” are allowed aboard without being in an animal carrier. All service animals must be harnessed and controlled by the passenger at all times. The owner should take appropriate action to protect their service animals from the movement of The Jet’s seats, as further described under “Seating” above. Blade and Operator adhere to the Americans with Disabilities Act (“ADA”). The ADA does not cover emotional support dogs. Therefore, emotional support dogs that cannot adhere to the pet policy above cannot travel aboard the Streamliner.   11. Children. All passengers, regardless of age, must have their own purchased seat. Children under the age of 18 must be accompanied by a parent or guardian over the age of 18; or, you must be provide Blade with the full name and contact information (including a valid phone number) for parents or guardians over the age of 18 who will be delivering the underage passenger to the Streamliner at the point of departure and meeting the underage passenger at the point of arrival. By using the services, you acknowledge and agree that a minor passenger’s participation in the services is voluntary and involves certain known and unknown risks, including but not limited to, accidents or injuries arising from or related to the services (including, but not limited to, injuries related to the Streamliner’s seats and footrests) and on behalf of any minor passenger for which you have legal responsibility you assume all risk of personal injury (including death) or property damage that such minor passenger may suffer while participating in the services.
  12. Bicycles. At no time may a bicycle of any kind be brought onboard into the passenger seating area. Subject to availability and the purchase of an excess luggage upgrade, bicycles may be stowed in the luggage bay of the Streamliner. Passengers must confirm bicycle availability by reaching out to our Flier Relations team at info@blade.com or (844-359-2523) By using the services, you acknowledge and agree that items in the luggage bay may shift during operation and cause damage to the bicycle. In addition, travel on the Streamliner involves certain known and unknown risks, including but not limited to, accidents related to the services and you assume all risk of property damage to your bicycle while participating in the services. You further acknowledge that the provisions set forth in the “Limitation of Liability” section below expressly apply to bicycles stored in the luggage bay of the Streamliner.
  13. Allergies. The onboard menu features food that may contain or come into contact with common allergens, such as dairy, eggs, wheat, soybeans, tree nuts, peanuts, or wheat. Depending on the seriousness of your allergy and based on your advice, we will be happy to remove items from service on board and make courtesy announcements to other guests.   14. Smoking and Smokeless Tobacco. Smoking and smokeless tobacco products of any kind, including the use of electronic, simulated smoking materials, e-cigarettes, smokeless cigarettes, vaping products, medical marijuana, or pipes is prohibited.
  15. Lost & Found. Blade will make every effort to locate an item reported as left on a Streamliner and return that item to the owner. Any food or other perishable items left on the Streamliner will be discarded. Once an item is found, owners must provide a pre-paid shipping label to Blade in order to receive the item. Unclaimed items and items not retrieved via a pre-paid shipping label provided by the owner will be donated after 30 days. All proceeds will be donated to a charity.   16. Acceptable Conduct. Travelers are expected to exhibit professional courtesy and behavior onboard the Streamliner. Phone calls and conversations must not disrupt the experience of other travelers and must be kept at a low volume level. Audio playback on personal electronic devices is not permitted without headphones. All devices including cell phones must be placed on silent or vibrate for the duration of the trip. All applicable laws and/or crew member instructions must be followed during boarding and transit. Blade and/or Operator reserve the right to remove any passenger who, in Blade’s or Operator’s sole opinion, is exhibiting unacceptable behavior or who fails to follow crew member instructions. Examples of unacceptable behavior include, but are not limited to, intoxication, using illegal or prohibited substances, rowdy, loud, lewd, offensive, or pernicious acts.
  17. Consent for Sharing Personal Information. By purchasing a seat and/or using the services, you grant permission and consent to Blade to share your personal information (including name, e-mail address and contact information) with Operator for use by Operator for operational, regulatory and/or promotional/marketing purposes, including, without limitation, facilitating travel arrangements, complying with applicable laws and regulations and/or providing you with informational and/or marketing communications regarding Blade’s and/or Operator’s services.   18. Publicity. By using the services, you grant permission to Blade and Operator to be photographed, recorded and/or interviewed in connection with its services and for the photographs, recordings and interview materials to be used and released publicly, and you release Blade and Operator and any photographer from any future claims, including claims of publicity, privacy or pre-approval that you have, as well as from any liability arising from the use of said photographs or recordings.
  19. Operation. Operator and the driver of the Streamliner are authorized to take all necessary measures to ensure safety. Operator and driver of the aircraft shall have full authority and complete discretion as to whether there shall be any deviation from the specified route and where alternate and/or immediate modifications shall be made. Blade does not control operations of Operator, which are the sole responsibility of Operator, and Blade is not liable for the operation, action and undertakings of Operator.
  20. Damages. Client shall be held liable for any and all damages to the Streamliner and property of Operator or Blade, which was caused by Client or Client's guests.
  21. Emergency Authorization. In the event of injury, illness or any other medical attention or treatment, by using the services, you grant permission to Blade and Operator and each of their officers, directors, agents, employees, independent contractors, affiliates and other hired third parties to render, secure, and/or authorize necessary medical treatment for you and agree to be financially responsible for any costs incurred as a result of such treatment.
  22. Assumption of Risk. By using the services, you acknowledge and agree that your participation in the services is voluntary and involves certain known and unknown risks, including but not limited to, accidents or injuries arising from or related to the services and you assume all risk of personal injury (including death) or property damage that you may suffer while participating in the services.
  23. Limitation of Liability. Blade and Operator assume no responsibility for acts or omissions of others, including interline partners, hotel partners, or parking lot partners, except as imposed by law. In no event shall Blade or Operator be liable for consequential or incidental damages for loss, damage or delay, including weather delays. By using the services, you voluntarily, expressly and knowingly WAIVE, RELEASE AND HOLD HARMLESS Blade, Operator and all of their respective officers, directors, agents, employees, independent contractors, affiliates and other hired third parties, individually and collectively (the “Released Parties”), from any and all claims, whether known or unknown, liabilities, expenses, damages, and causes of action at law, or in equity, for any injury (including death) or property damage which you (or any minor passengers in your care) may suffer as a result directly or indirectly from participation in the services INCLUDING, BUT NOT LIMITED TO, ALL CLAIMS OF NEGLIGENCE, WHETHER ACTIVE OR PASSIVE, AND WHETHER CAUSED BY YOUR OWN NEGLIGENCE OR THE NEGLIGENCE OF THE RELEASED PARTIES. You further agree that this waiver and release extends to all such claims, expenses, causes of action, or lawsuits that could be brought by you, any minor passengers in your care, or your or their respective heirs or legal representatives. You will not institute or prosecute any actions or suits at law or in equity, nor aid any institution or prosecution of any claim, demand, action or cause of action against the Released Parties for any personal injury, property damage, or other loss or damage of any nature or kind, costs or attorneys’ fees sustained or that might be sustained which are related to, resulting from, or connected in any manner with your participation in the services (except as relates to the wanton or willful misconduct of Blade or Operator). In no event shall Blade or Operator be liable for consequential or incidental damages for loss, damage or delay. You agree that this agreement may be pleaded as a complete defense to any action or proceeding that may be brought or instituted by you or you respective heirs or legal representatives. You further agree to INDEMNIFY, SAVE AND HOLD HARMLESS the Released Parties and each of them from any loss, liability, damage, or cost, including reasonable attorney’s fees, which arises as a result of (1) your breach of these Terms & Conditions and/or (2) your participation in the services. All waivers, releases, and limitations on liability contained herein are agreed to by you in your individual capacity and on behalf of any minor passengers for which you have legal responsibility.
  24. Arbitration. At Blade’s sole election, all legal suits, actions, proceedings, claims and disputes arising under or relating to these Terms and Condition (Legal Actions”) may be settled by binding arbitration by a single mutually agreed upon arbitrator in New York, New York or another location mutually agreed to by the Parties. The arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the American Arbitration Association (the “AAA”), but not the administration of the AAA if the Parties can agree to use a self-administered arbitrator and procedure. If the Parties are unable to agree on an arbitrator, one will be appointed by the AAA. Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessment of costs, expenses, and reasonable attorneys' fees. Any such arbitration shall include a written record of the arbitration hearing. The Parties reserve the right to object to any individual who shall be employed by or affiliated with a competing organization or entity. An award of arbitration may be confirmed in a court of competent jurisdiction. In any Legal Action between the Parties brought under or in connection with the subject matter of these Terms and Conditions, the prevailing party shall be entitled to an award of reasonable attorneys’ fees and costs from the non-prevailing party. Either Party may join claims arising from the same transaction or occurrence against any third-party who consents or is contractually bound to arbitrate in accordance with this provision. IT IS MUTUALLY AGREED BY AND BETWEEN THE PARTIES THAT THEY HEREBY WAIVE TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM BROUGHT BY EITHER PARTY AGAINST THE OTHER PARTY ON ANY MATTERS ARISING OUT OF OR IN ANY WAY CONNECTED WITH THESE TERMS AND CONDITIONS OR THE RELATIONSHIP OF THE PARTIES HEREUNDER.
  25. Governing Law. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, notwithstanding any of its conflicts of law provisions to the contrary. For any Legal Actions that are not part of the arbitration process set forth in the preceding Section, Client and Blade hereby consent and submit to the personal jurisdiction of the state and federal courts located in New York, New York and consent to the venue of such courts for any such matters.
  26. Severability. If any provision of these Terms and Condition is found to be illegal or invalid, such provision will be modified to the extent necessary to comply with applicable law and refashioned to best approximate the original intent of the Parties, and the remaining provisions shall remain in full force and effect in accordance with their terms.
  27. No Waiver. No delay or omission by Blade in exercising any right under these Terms and Conditions shall operate as a waiver of that or any other right, nor shall any single or partial exercise of any such right preclude any other or further exercise thereof or the exercise of any other right.
  28. Not Construed Against Drafter. No provision of these Terms and Conditions shall be construed by any court or other judicial authority against any party hereto by reason of such party's being deemed to have drafted or structured such provisions.
  29. Entire Agreement. These Terms and Conditions embody the entire agreement and understanding between you and Blade in respect of the transactions contemplated by these Terms and Condition and supersedes all prior agreements, contracts, representations, warranties, promises, covenants, arrangements, communications, and understandings, oral or written, express or implied, between or among you and Blade with respect to the subject matter of these Terms and Conditions.
